As part of TRYKE's efforts to make the service great and specialized for each of our Users (you), and in accordance with Republic Act No. 10173, otherwise known as the “Data Privacy Act of 2012”, its Implementing Rules and Regulations (“IRR”), and Orders and Circulars issued by the National Privacy Commission (“NPC”) you will be asked to provide your personal information anytime you avail the services of, contact, participate in surveys and raffle promotions, or attend the trainings provided for by TRYKE.

  1. Personal Data
  2. Definition. As defined by the Data Privacy Act, shall refer to “any information whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual”.
    This means any information about the User, from which he/she can be personally identifiable, including but not limited to name, official identification card number, birth certificate number, government identifications such as driver's license, passport number, nationality, address, telephone number, fax number, bank details, credit and debit card details, race, gender, date of birth, marital status, resident status, educational background, financial background, personal interests, email address, user location (even if the app is closed or running in the background so long as user is online) occupation, designation and the organization you work in and the industry in which you work. Personal Data also includes any information about the user which you have provided to the TRYKE in registration forms, application forms or any other similar forms in whatever format, and/or any information about you that has been or may be collected, stored, used and processed by the Company from time to time and includes sensitive personal data such as data relating to health, religious, political or other similar beliefs.

  3. GENERAL STATEMENT

The User is not obligated to provide the personal information that we have requested, but, if you choose not to do so, in many cases, TRYKE will not be able to provide you with our services, customer care, respond to your queries, nor will you be able to participate in our promotions, or special offers.
    TRYKE is committed to protecting your privacy as our User. As your trusted ride partner, the confidentiality of your information remains our top priority and we shall exert all reasonable efforts to protect it against unauthorized use, access, or disclosure.
    If you are a Third-Party Partner, vendor, supplier, merchant or service provider, the provision of your Personal Data is mandatory and failure to provide your Personal Data may be a breach of laws or regulatory requirements, and may prevent the Company to engage you to provide products or services, or issue payments to you for the products or services provided.

  1. How TRYKE Collects information:

When a User downloads, uses or avails the services provided by TRYKE (including the use of TRYKE APP), TRYKE collects a variety of sensitive and personal information including your name, phone number, e-mail address, mailing address, delivery address, contact preferences, birthday, age, gender, and other personally-identifying information. As a matter of policy, TRYKE does not collect credit card details as these are collected, processed, and stored by the payment provider you chose from the options provided to you pursuant to the terms, policies, and processes. However, in case you are entitled to a refund, we may collect your bank account details.
    If you choose to provide us with your personal information, you must provide us with your correct, complete, and up-to-date information. We reserve the right to ask for a government-issued ID for authorization and validation purposes.
    Emails are not entirely safe. For security purposes, TRYKE will not use this platform to obtain confidential information from you such as your account numbers, passwords, and other personal or sensitive information.
    TRYKE will provide for a safe terminal for the process of collecting sensitive and personal information and will never ask you to confirm any such information by clicking on a link in an email. Do not attempt to click on any suggested link to any TRYKE website, do not provide confidential information via emails, and do not provide confidential information to access the link to any TRYKE-related website.
    In addition to the Personal Data that you will directly provide to TRYKE upon availing of its services, TRYKE may also collect your Personal Data from other sources such as:

    1. Application or registration forms or other similar forms that you have filled out;
    2. Publicly available documents, such as directories;
    3. TRYKE's social media pages, if you follow, like, subscribe or are a fan of such pages;
    4. Credit reporting agencies;
    5. Various entities or divisions affiliated with the Company;
    6. Surveys or other modes of data collection obtained from TRYKE organized events, activities or contest; and
    7. TRYKE's digital properties include but are not limited to TRYKE's official website, TRYKE APP, or other user-facing software where personal data may be collected using cookies or similar means.

  3. Types of Personal Data Collected
    1. Your name and other particulars such as, but not limited to, contact details, address, birthdate, and educational background
    2. Details and photocopies of your government or other IDs, and other digital photos and biometrics, if any, captured or submitted in the course of your transactions with us.
    3. Voice recordings of our conversations with you
    4. Information about your transactions with third parties, including merchants and utility companies
    5. Non-personal information provided by the electronic device you are using such as the IP address, operating system, browser type and version, and other machine-related identifiers

  5. TRYKE may use cookies to optimize User experience. Cookies are small text files that are placed on your computer or mobile phones when browsing websites. The small amount of data in these files is commonly used as anonymous unique identifiers. This enables us to serve you better as it helps us understand your usage patterns which may include your personal interests and needs. Cookies provide us with data on pages, products, and information that you find useful. This can help us analyze the effectiveness of our advertisements and marketing strategies. In short, these are used to tell the server that users have returned to our App.

  6. Use of Personal Data or Information
  7. TRYKE may use the personal information collected from you for any of the following purposes:

    1. For creation, development, operation, delivery, and improvement of services, content and advertising, loss prevention, and anti-fraud purpose;
    2. For the processing of bookings, orders and delivery of products or services;
    3. For verification of identity, age, and authorization of Users;
    4. For processing of User subscriptions and delivery of service;
    5. For the processing of User participation in any events, activities, contests, research, and promotions facilitated, organized or sponsored by TRYKE;
    6. For strategy and sales development;
    7. To provide proper and timely assistance to the appropriate medical personnel and/or law enforcement authorities in case of an accident in connection with the use of the services of a transportation service provider through the App or in case of other emergencies involving User life, health, and/or safety;
    8. For internal purposes to comply with TRYKE's internal policies and reporting obligations to governmental authorities, such as but not limited to accounting, auditing, data analysis, and research to improve services and customer communications; and
    9. For service announcement, contests, promotions, and upcoming event;
    10. For the purpose of engaging merchants to provide products or services;
    11. To facilitate any checks as may be required by TRYKE in order to engage Users;
    12. To contact merchants, vendors, or Users in connection with existing or previous TRYKE business relations;
    13. For other legitimate purposes as may be allowed by law; and
    14. As necessitated by the service, such as but not limited to the support needed in delivering our services and products to you; complying with existing laws, rules, and legal processes; implementing policies and terms and conditions; addressing fraud, security, or technical issues; protect our rights, interests, properties or security and that of other Users and Third-Party partners.

  8. Use of Personal Data or Information
  9. The User may terminate TRYKE's right to obtain information from the user. If the USER wishes to terminate, he / she may revoke the consent that TRYKE has obtained from them by notifying TRYKE through the official contact details provided by TRYKE.


  10. Disclosure to Third Parties
  11. The User's Personal Data may be transferred, accessed by, or disclosed to third parties for the purposes and additional purposes of a data sharing agreement, which law may require. TRYKE may engage other companies, service providers, or individuals to perform functions on its behalf and, consequently, provide access to or disclose your Personal Data to such service providers or third parties. These third parties include, but are not limited to the following:

    1. Company's partners, which include parties with whom the Company collaborates with for certain events, programs and activities, and in the implementation of cashless transaction;
    2. event management companies and event sponsors;
    3. marketing research companies;
    4. service providers, including information technology (IT) service providers for infrastructure, software and development work;
    5. professional advisers and external auditors, including legal advisers, financial advisers and consultants, and regulatory entities; and
    6. Government entities which require disclosure of personal data.

  12. Data Retention

Subject to applicable requirements of the Data Privacy Act and other relevant laws and regulations, Personal Data shall not be retained by TRYKE for a period longer than necessary and/or proportionate to the purposes for which such data was collected. TRYKE retains your Personal Data for as long you maintain your account with it and for as long as your Personal Data remains necessary for the services or purposes mentioned above or for other legal or business purposes. The period of retention may be extended when circumstances so permit, such as, but not limited to, for purposes of safety, security and fraud prevention and detection.

  14. Privacy Rights
  15. Subject to the requirements, conditions and exemptions under the Data Privacy Act, Users shall have the following rights:

    1. To access personal data, including:
    2. To dispute any inaccuracy or error in your personal data and require TRYKE to correct or update the same.
    3. To obtain a copy of your personal data in an electronic or structured format for your further use.
    4. To suspend, withdraw, or order the blocking, removal, or destruction of your personal data from TRYKE system, provided such action is neither critical nor required by applicable laws and regulation to maintain the products and services that you availed with TRYKE.
    5. e. To file a complaint with the National Privacy Commission.
  16. Privacy Rights
  17. The TRYKE Website may contain links or may be integrated with third parties' websites and services. Please note that TRYKE is not responsible for the collection, use, maintenance, sharing, or disclosure of data and information by such third parties. If you provide information directly to such sites or services, TRYKE will not be responsible for the data processing practices or privacy policies breach of such sites or services.

  18. Modifications
  19. TRYKE has the right to and may modify, update or amend the terms of this Privacy Notice at any time it deems necessary by placing the updated Notice on its website. Your continued use of the TRYKE's services, purchase of Company's products or continued engagement with the Company following the modifications, updates or amendments to this Notice shall be deemed acceptance of such modifications, updates or amendments.
